Tracking the Spread: COVID Litigation Issues in the Restaurant Industry

Employees from across the country have now filed more than 2,300 COVID-19-related lawsuits against their employers and former employers. Hospitality employers are the 5th most frequently sued industry.  With our industry continuing to reopen, more lawsuits are sure to follow.  Not all of these claims have focused on the Family First Coronavirus Response Act (FFCRA) — the federal legislation governing Emergency Paid Sick Leave and Emergency Family and Medical Leave — but rather a substantial number of lawsuits have alleged employer impropriety using COVID-19 as a factual backdrop. Angelo Amador, Executive Director of the Restaurant Law Center, will host Alden Parker, Co-Chair of the National Hospitality Industry Group at Fisher & Phillips, LLP, a Law Firm Partner of the Restaurant Law Center. We will look into the firm’s COVID-19 Employment Litigation Tracker and discuss ways to help restaurants stay one step ahead of workplace lawsuits stemming from virus-related concerns.
