New U.S. Department of Labor Guidance for Restaurants on “Side Work” and the FLSA’s Tip Credit
Angelo Amador and Paul DeCamp will be discussing the Restaurant Law Center’s litigation around the issue of “side work” at restaurants that take advantage of the tip credit and the new guidance issued by the Department of Labor on this issue. Paul was lead counsel in Restaurant Law Center, et al., v. U.S. Department of Labor, et al. Paul also co-chair’s Epstein Becker’s Wage and Hour practice group and is a former Administrator of the U.S. Department of Labor’s Wage and Hour Division. The webinar will specifically cover the issue of tipped workers and the new guidance’s impact on working time spent on tasks that do not specifically generate tips—such as wiping down tables, filling salt and pepper shakers, and rolling silverware into napkins, duties generally referred to in our industry as “side work.”
