Photos Etc., et al. v. Home Depot et al.

Directly related to the In Re Payment Card Interchange Fee case, a group that supported the settlement vacated by the Second Circuit, filed a Petition for Certiorari with the Supreme Court asking the Court to reinstate the earlier class certification and settlement. On February 21, those trade groups that, like us, objected to the settlement filed a Brief in Opposition to the petition. On March 27, the U.S. Supreme Court decided not to take up the appeal seeking to reinstate the 2012 settlement that the Association opposed in our long-running “swipe fee” case against Visa and Mastercard. We agreed with the determination of the Second Circuit that the settlement was “unreasonable and inadequate.
