Issue

The question presented is whether to be exempt from the Federal Arbitration Act must a class of workers that is actively engaged in interstate transportation also be employed by a company in the transportation industry.

The Restaurant Law Center filed a brief in support of the respondent, arguing that independent business owners, whose transportation work includes only, as in this case, local and intrastate movement of baked goods, are not exempt from the Federal Arbitration Act because their employees are not “transportation workers” as they are not primarily engaged in the movement of goods through the traditional channels of interstate commerce.
